Rights & Licensing

1. Use of Stallion Kamyar® Content

Photographs, films, film stills, graphics, illustrations, logos, brand elements, pedigree presentations, musical works, sound recordings, audiovisual productions, texts and other creative materials relating to Stallion Kamyar® may be protected by copyright, trademark rights, design rights, related rights or other statutory intellectual property rights.

Publication of such content on https://stallionkamyar.com does not constitute a general permission to reproduce, adapt, redistribute, make available to the public or commercially exploit the material.

Where an intended use is not permitted by law or already covered by existing rights of use, the appropriate authorisation of the respective rights holder is required.

Uses permitted by law remain unaffected.

2. Ownership, Official Breeding Representation and Trademark Rights

DF Kamyar / Stallion Kamyar® is owned by EMERALD EQUINE & MEDIA GROUP UG (haftungsbeschränkt).

The official breeding marketing and representation of the stallion is carried out exclusively by EMERALD EQUINE & MEDIA GROUP UG (haftungsbeschränkt) or by persons expressly authorised by the company.

Third parties are not authorised to present DF Kamyar / Stallion Kamyar® as their own stallion or as a breeding stallion currently under their management where this does not correspond to the actual ownership and rights of disposal.

Likewise, use of the name DF Kamyar, the registered trademark Stallion Kamyar®, or images of the horse must not create the false impression that external breeding offers or frozen-semen offers are approved, authorised or organised by the current owner.

The registered trademark Stallion Kamyar® is owned by Sandra Diana Wolczik, who is recorded in the trademark register under her former name Sandra Diana Vetter.

The trademark is registered in Nice Classes 9, 16, 18, 25, 28, 30, 35 and 41.

EMERALD EQUINE & MEDIA GROUP UG (haftungsbeschränkt) and the trademark owner expressly reserve the right to take legal action against misleading advertising, unauthorised trademark use and other infringements of their rights.

3. Permission and Licensing Requests

Individual permissions or licences may be requested for the use of protected Stallion Kamyar® materials.

This may include:

  • Press and editorial publications
  • Film and television productions
  • Documentaries and interviews
  • Books, magazines and digital publications
  • Advertising and marketing campaigns
  • Licensed products and merchandising
  • Educational, research and cultural projects
  • Exhibitions and public presentations
  • Photographs, film stills and audiovisual materials
  • Logos, brand emblems and the Breeding and Heritage Seal

Every request is assessed individually with regard to the intended type of use, scope and rights required.

There is no entitlement to the granting of a licence.

4. Commercial Use and Licensing Agreements

Commercial use of protected photographs, logos, films, musical works, graphics, brand elements or other content requires the appropriate rights of use unless the intended use is permitted by law.

A licence may, in particular, define or restrict:

  • Purpose and type of use
  • Territory
  • Duration
  • Media and publication formats
  • Editing and modification rights
  • Transfer to third parties and sublicensing
  • Copyright and credit requirements
  • Licence fees and other contractual conditions

Permission granted for a particular project applies only within the agreed scope.

Any additional use requires further authorisation unless already covered by the existing licence or applicable law.

5. Editorial and Press Use

Editorial reporting about Stallion Kamyar®, the breeding programme, pedigree, film productions or associated persons is permitted within the framework of applicable law.

Merely referring to the trademark or reporting factually about Stallion Kamyar® does not in itself create a licensing obligation.

However, use of protected photographs, film stills, graphics, music or other works may require separate authorisation.

Where materials are expressly provided for press purposes, the licensing terms and usage restrictions communicated with those materials apply.

Statutory rights, including permitted quotation and other copyright exceptions, remain unaffected.

6. Photography and Image Rights

Photographs published on this website are subject to the rights of their respective authors and other rights holders.

Other photography, including work by Joanna Jonientz, remains subject to the respective copyright and usage rights applicable to those works.

Additional creator and source information may be provided in image captions, media descriptions or on the Image Credits page.

Publication of an image on this website does not constitute general permission to download, republish or commercially reuse it.

7. Film, Music and Audiovisual Rights

Film productions, original compositions, sound recordings, audiovisual works, film stills, music videos and associated promotional materials may be protected by copyright and related rights.

This applies in particular to materials associated with Stallion Kamyar® film productions and musical works by Bastian Lee Jones.

Depending on the work and intended use, rights of several parties may be involved, including composers, authors, performers, filmmakers, film producers, phonogram producers and other holders of exclusive rights.

Appropriate authorisation may be required for synchronisation, reproduction, public performance, broadcasting, publication or commercial exploitation.

A licence can only be granted to the extent that the licensing party itself holds the necessary rights.

8. Pedigree Presentations, Research and Graphic Works

Pedigree diagrams, bloodline maps, genealogical graphics, research presentations and other visual materials created for Stallion Kamyar® may be protected by copyright or other rights.

Historical, genealogical or other factual information underlying such materials must be distinguished from the specific creative presentation and from any protected third-party database content.

Rights in third-party database content, photographs, illustrations or other materials remain unaffected.

9. Brand Assets and Breeding & Heritage Seal

Logos, brand emblems, word and figurative marks and the Stallion Kamyar® Breeding and Heritage Seal may be protected by trademark rights, copyright or other statutory rights.

Use requiring a licence by third parties is subject to appropriate authorisation.

Any permission granted may specify requirements regarding purpose, duration, territory, medium, placement, design, proportions and presentation of the brand.

The Breeding and Heritage Seal is a proprietary brand and identification element used in connection with authorised Stallion Kamyar® materials.

It does not constitute governmental, regulatory, veterinary, association-based or independent certification.

It must not be misleadingly represented as an official or independent certification mark.

10. Third-Party Materials and Rights

Certain materials displayed on this website may be subject to third-party rights.

These may include festival logos, award marks, certificates, laurels, database materials, third-party photography, audiovisual content, graphics and other protected works.

The respective rights remain with their legitimate rights holders.

EMERALD EQUINE & MEDIA GROUP UG (haftungsbeschränkt) can grant rights in third-party materials only to the extent that it is itself authorised to do so.

Where appropriate, requests concerning such materials must be directed to the respective rights holder.

A licensing agreement is concluded only when a corresponding legally binding agreement has been entered into.

Submitting an enquiry does not itself grant any right of use.
